An individual who was paralyzed in a subway attack claims that the city and the MTA have not taken adequate measures to prevent passengers from being shoved onto subway tracks or trains, despite it being a well-known issue.
Emine Yilmaz Ozsoy, an artist from Queens, was left paralyzed from the chest down after being pushed into a moving F train by a madman on May 21, 2023, at the Lexington Avenue-63rd Street station.
The lawsuit filed in Manhattan Supreme Court alleges that subway authorities failed to protect her from the danger posed by criminal and mentally unstable individuals pushing others onto the tracks or in front of trains. It also states that no platform barriers have been installed to prevent such incidents.
Reports indicate that since 2020, dozens of people have been pushed onto subway tracks.
Ozsoy, who is seeking damages, shared her story with The Post in February, expressing her desire to leave New York for treatment in Florida. A GoFundMe page was set up to support her medical expenses.
In addition to suing the alleged attacker, Ozsoy has also filed lawsuits against the train conductor for excessive speed and the EMTs for inadequate care during her rescue and transport to the hospital.
The criminal case against the alleged attacker, Kamal Semrade, is still pending.
The MTA and the city Law Department have chosen not to comment on the matter.
