A federal court decision on Friday rejected OpenAI’s attempt to dismiss a lawsuit filed by The Intercept. The lawsuit concerns the unauthorized use of journalists’ work to train ChatGPT without permission or credit.
One of The Intercept’s claims under the Digital Millennium Copyright Act will proceed against OpenAI, while another claim was dismissed. All claims against Microsoft were also dismissed.
“This ruling underscores the importance of the DMCA in protecting news organizations from AI companies using their content without authorization. It provides a legal avenue to challenge the unauthorized use of digital news content for AI training,” said Matt Topic, attorney for The Intercept at law firm Loevy + Loevy.
