Harvey Weinstein’s attorneys have officially filed a legal claim against New York City on Tuesday, alleging that their client is receiving inadequate medical care in unsanitary conditions while in custody at Rikers Island jail complex.
The notice of claim, which is the initial step in initiating a lawsuit, accuses the facility of neglecting to manage Weinstein’s medical conditions, including chronic myeloid leukemia and diabetes. The claim also cites negligence in providing proper care, such as maintaining hygienic conditions and supplying clean clothing.
Both the city’s law department and Department of Correction have not yet responded to requests for comments on the matter.
Weinstein’s attorney, Imran H. Ansari, expressed concern over the conditions at Rikers Island, stating, “When I last visited him, I found him with blood spatter on his prison garb, possibly from IV’s, clothes that had not been washed for weeks, and he had not even been provided clean underwear—hardly sanitary conditions for someone with severe medical conditions,” likening the facility to a “gulag.”
Weinstein, aged 72, has been held in city custody since earlier this year following the nullification of his 2020 rape conviction. The case is scheduled to be retried in 2025, and Weinstein maintains his innocence.
Throughout the year, Weinstein has faced various health issues, leading to brief hospitalizations in April and July. His legal team has disclosed that he has been treated for diabetes, high blood pressure, spinal stenosis, COVID-19, and fluid accumulation in his heart and lungs.
The legal claim is seeking $5 million in damages, arguing that Weinstein was returned to Rikers Island before fully recovering from his health setbacks.
Following his convictions, Weinstein’s film production company entered bankruptcy proceedings and established a $17 million fund for sexual misconduct claims.
Although Rikers Island jail is scheduled for closure in 2027, the city has delayed the deadline for its closure.
