This is not the first time Marty Small Sr. has faced accusations; he was previously charged with voter fraud but acquitted both times, later filing a lawsuit against the state and others for malicious prosecution and civil rights violations. In 2015, a New Jersey Superior Court appellate panel ordered the dismissal of Small’s lawsuit.
