Last week, I participated in a Federalist Society teleforum discussing the legal implications of Congress’ decision to limit judicial review of the Mountain Valley Pipeline in response to environmentalist groups’ litigation efforts. As detailed in my article here, the U.S. Court of Appeals for the Fourth Circuit initially resisted Congress’ jurisdiction-stripping move but eventually yielded to it (following Supreme Court intervention).
During the teleforum, I had the privilege of joining Professor Daniel Farber, Professor Alan Trammell, Rachel Jankowski from the U.S. House of Representatives, and Magistrate Judge Robert Numbers II, who expertly moderated the discussion.
