A Virginia technology company has reached agreements with the Department of Justice (DOJ) and the Department of Labor to resolve allegations of discriminatory job postings after posting a “whites only” job ad last year.
The DOJ announced on Monday that Arthur Grand Technologies Inc. will pay a civil penalty of $7,500 to the U.S. Treasury and compensation of $31,000 to the complainants for violating the Immigration and Nationality Act with the job ad.
Investigation Findings and Legal Violations
The Department of Labor found that Arthur Grand violated Executive Order 11246, which prohibits discrimination by federal contractors, by discriminating against job seekers based on race and national origin in the recruitment process for a salesforce business analyst position.
An investigation revealed that a job ad posted by a recruiter in India discouraged certain individuals from applying. Arthur Grand agreed to take corrective actions to avoid legal proceedings as part of a conciliation agreement.
DOJ Civil Rights Division Assistant Attorney General Kristen Clarke stated, “It is shameful that in the 21st century, we continue to see employers using ‘whites only’ and ‘only U.S. born’ job postings to lock out otherwise eligible job candidates of color.” The department will continue to hold employers accountable for violating federal civil rights laws.
The company described itself as a “minority-owned” business that values diversity among its staff and leadership. Arthur Grand has agreed to pay compensation and take corrective actions as part of the settlements.
The company is also required to train its staff on legal requirements, update employment policies, and undergo monitoring by relevant departments. Additionally, specific workplace training will be provided to employees involved in recruitment processes to prevent discrimination in the future.
Similar Controversy and Congressional Inquiry
Another controversy arose around a job posting by the Kraft Group, which owns the New England Patriots, requiring applicants to be “BIPOC (Black, Indigenous and Person of Color).” The ad was criticized for discriminating against white candidates.
Title VII of the Civil Rights Act of 1964 prohibits unlawful employment practices based on race, color, religion, sex, or national origin.
