Two Democratic senators, Elizabeth Warren (D-Mass.) and Richard Blumenthal (D-Conn.), have requested the Biden administration to clarify the conditions under which the Insurrection Act can be invoked. This Act, rarely used in history, was last employed in 1992 by President George H.W. Bush during the Los Angeles riots.
Trump’s remarks on social media about initiating a national emergency and utilizing military assets for mass deportations raise concerns about the direct involvement of the military in immigration enforcement. The U.S. military has historically supported immigration and border operations, primarily offering logistical and surveillance assistance rather than direct enforcement.
Furthermore, Trump’s intention to invoke the Alien Enemies Act of 1798 to target criminal gangs and dismantle cross-border criminal networks adds complexity to his immigration strategy. This Act permits the detention, relocation, or deportation of individuals from countries at war with or invading the United States or engaging in predatory incursions.
The Alien Enemies Act has been invoked during major conflicts such as the War of 1812, World War I, and World War II. Its most recent utilization was in 1942 by President Franklin D. Roosevelt to relocate Japanese nationals and U.S. citizens of Japanese descent following the Pearl Harbor attack.
