The 11th U.S. Circuit Court of Appeals has blocked the Education Department’s expanded Title IX gender rules in Alabama, Georgia, Florida, and South Carolina. The federal appeals court granted an injunction pending appeal, stating that the plaintiffs had a strong chance of winning on the merits and that the new rules could cause irreparable harm. The court found that the expanded Title IX protections based on “gender identity” could be contrary to law and in excess of statutory authority. The decision comes in response to a lawsuit brought by the four states, along with several organizations, challenging the Department of Education’s final rule expanding Title IX to include sexual orientation and gender identity. The court’s ruling aligns with the public interest and blocks enforcement of the revised Title IX rules in the four states. 22 court orders have halted the implementation of the new rule in 26 states: Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, West Virginia, and Wyoming.
