The Court of Appeals for the 11th Circuit also grappled with the 90-day provision in a similar manner. Both the individual and the Department of Justice (DOJ) resisted the commonwealth’s efforts to invoke the Purcell principle, a legal doctrine established by the Supreme Court to generally prohibit last-minute changes to election administration.
Virginia contended that Purcell would advise against the judge issuing an injunction so close to the election. On the other hand, the DOJ argued that the two laws had comparable objectives and that the Purcell principle should not be interpreted as preventing the National Voter Registration Act (NVRA) from halting Virginia’s program.
