A federal judge has recused himself from a case involving Palestinian activists seeking to block the White House’s policy to support Israel. U.S. Circuit Judge Ryan Nelson confirmed his recusal in a brief order issued on Thursday, stepping away from the case “out of an abundance of caution” despite disputing arguments for recusal.
The activists had moved for Judge Nelson’s disqualification, citing a trip he took to Israel with other judges in March. They alleged that the judge’s participation in the trip could influence legal opinion in the United States. Following his recusal, U.S. Circuit Judge Consuelo Callahan was assigned to hear the case.
The plaintiffs in the case were appealing a previous order that dismissed their claims related to President Joe Biden’s support for Israel’s military activity in Gaza. The judge who dismissed their case stated that their claims fell outside the court’s limited jurisdiction and implored the defendants to reconsider their support for the military siege.
The Center for Constitutional Rights, one of the plaintiffs, sought Judge Nelson’s recusal to ensure impartiality. Meanwhile, the Biden administration expressed a desire for a cease-fire agreement in Gaza, while Israeli Prime Minister Benjamin Netanyahu insisted on the destruction of Hamas before agreeing to a permanent cease-fire.
