The Florida Supreme Court has sided with Gov. Ron DeSantis and other state officials in a legal battle regarding their opposition to a proposed amendment to the state constitution that aims to limit government interference in abortion issues.
Richardson’s petition alleged that DeSantis, Florida Attorney General Ashley Moody, and Florida Agency for Health Care Administration (AHCA) Secretary Jason Weida violated state laws by publicly advocating against the amendment.
Nevertheless, the Florida Supreme Court ruled in favor of the officials, stating that Richardson’s petition lacked legal basis and that the actions in question fell within the officials’ discretionary authority.
The justices concluded that Richardson’s request for a writ of mandamus, typically used to compel a legally required action, was not applicable in this case.
“The petitioner’s request falls outside the scope of mandamus,” the justices stated. “He challenges an executive power exercise that involves discretion on the basis that it violates a criminal or regulatory prohibition.”
The court clarified that mandamus is not intended for addressing executive actions that require judgment or discretion, especially when other legal options like civil enforcement or criminal proceedings are available.
Additionally, the justices found that Richardson failed to demonstrate a specific legal right that would compel DeSantis and the other officials to take a specific action or show any negligence in their legal obligations.
“He has not proven a clear legal right that would necessitate any Respondent to fail in their duty, and given the laws permitting criminal prosecution or civil enforcement, he cannot establish the absence of other remedies for the alleged misconduct,” the justices wrote.
As a result of the court’s ruling, DeSantis, Moody, and the other officials have the green light to continue their public opposition to the abortion amendment.
Richardson, a lawyer based in Palm Beach County who represented himself in the case, did not provide a comment when requested.
“Passage of Florida’s abortion amendment could have severe consequences for the state’s residents,” said Mat Staver, the organization’s founder and chairman. “Governor DeSantis and Attorney General Ashley Moody’s participation in the public discourse on Amendment 4 is not only permissible but crucial. They cannot shy away from their duty to inform the public about this misleading and extreme abortion amendment.”
