Former President Donald Trump is seeking to have special counsel Jack Smith’s classified documents case against him dismissed after prosecutors admitted to misleading a judge about the order of items in an evidence box. This revelation came after the FBI raided materials from Trump’s Mar-a-Lago property in August 2022.
In a post on Truth Social, Trump called for Smith’s arrest and argued that the case should be thrown out based on the new court filing. Smith’s team acknowledged that the order of items in the evidence box did not match the digital photographs taken during the raid.
The team provided possible explanations for the rearrangement of documents in the boxes, citing access by personnel, the size and shape of items, and the movement of smaller items like index cards and books. Trump accused Smith of evidence tampering and called for the immediate dismissal of the case.
Trump has pleaded not guilty to 40 charges related to the retention of classified documents at his home and obstruction of officials. Judicial Watch also suggested that the case should be dismissed following the admission of evidence tampering.
In response to the filing, Tom Fitton of Judicial Watch criticized the prosecution and the FBI’s handling of the classified documents. He pointed out the FBI’s admission of creating an index and replacing handwritten sheets with classified cover sheets.
