A report from a House committee and exclusive documents obtained by The Post reveal that a Venezuelan illegal migrant with suspected gang ties, Daniel Hernandez Martinez, was released last year and entered the US, where he proceeded to commit multiple crimes in New York City without being deported.
Hernandez Martinez, identified as a member of the suspected Tren de Aragua gang, committed at least 22 criminal offenses in New York City between June and November 2023, as per the House Judiciary Committee report.
After being first encountered by US Border Patrol near Ysleta, Texas, in January 2023, Hernandez Martinez was deported to Mexico under the Title 42 COVID expulsion order, only to later re-enter the US.
His crime spree in New York City included charges of petit larceny, criminal possession of a weapon, and assault, leading to involvement from US Immigration and Customs Enforcement (ICE) after his seventh encounter with the NYPD.
Despite being ordered deported in June 2024, Venezuela’s refusal to accept deportation flights has left Hernandez Martinez in ICE custody in Buffalo, NY indefinitely.
The House Judiciary report criticizes Vice President Kamala Harris and Homeland Security Secretary Alejandro Mayorkas for their support of lenient asylum and amnesty policies, including a memo issued by Mayorkas that restricted ICE officers’ ability to arrest criminal aliens.
In response to the Biden administration’s immigration policies, House Republicans impeached Mayorkas in February, citing the release of over 5.4 million illegal aliens into the US and the resulting insecurity.
ICE representatives did not provide immediate comment on the situation.
