Alaska, Utah, and Wyoming’s attorneys general have joined Kansas in legal action against the Biden administration. The lawsuit challenges the expansion of Title IX anti-discrimination provisions to include “gender identity.” Kansas Attorney General Kris W. Kobach announced the lawsuit, arguing that the administration’s rewrite of Title IX forces schools to allow participation in sports teams based on “gender identity” rather than biological sex. The lawsuit names U.S. Department of Education Secretary Miguel Cardona and U.S. Department of Justice Attorney General Merrick Garland, alleging that the revisions seek to politicize education to conform to radical ideological views. The lawsuit claims that the Biden administration is attempting to institutionalize transgender ideology in schools and tie funding to it, rather than focus on the original mission of Title IX to protect women and girls from discrimination in education and sports. Joining Kansas in the lawsuit are the attorneys general for Alaska, Utah, and Wyoming. The Biden administration is attempting to defy federal law and use federal agencies in a way that no other presidency in American history has done. The changes to Title IX are particularly concerning as they could have lasting psychological effects on minor children and put them at risk. The director of the American Civil Liberties Union’s LGBTQ & HIV Project praised the administration’s efforts to prevent discrimination. The White House has released a Transgender Equality Toolkit outlining steps taken by key agencies to implement the executive order. Changes to federal identification documents now allow for gender identities outside of biological sex. Over 80 transgender rights advocacy organizations have urged President Biden to finalize changes to Title IX to protect transgender, nonbinary, and gender expansive youth in school sports. The Affordable Care Act prohibits discrimination in health programs based on Title IX, which in turn prohibits discrimination based on sex. The Biden administration’s changes to Title IX include prohibiting sexual discrimination in schools and including sexual orientation and gender identity for LGBT students. Districts that treat transgender students differently could lose federal funding.
